McCormick-Weeks Limited (“the Company”)
Formation of Contracts
- On receipt of a purchase enquiry from you, the Company will prepare and send you a Quotation setting out the price for the goods requested, the delivery costs, VAT payable and the delivery arrangements.
- Before an order is accepted by the Company, the customer must confirm the acceptance of the Quotation in writing either by fax, post or email.
When ordering Finials
- Please check that size and style of finial chosen is suitable for diameter of pole used.
- All finials are supplied inserted with a wood thread screw for wooden poles or a metal insert thread for metal poles.
- Please give detailed colouring instructions, with diagrams if necessary, if combinations of standard colours or special colours are required.
When ordering Poles, Rings & Tassels
- Please state the length, diameter and style of pole required.
- Please order the length of pole required excluding finials. As a general rule of thumb, allow 100-150mm either side of each architrave in addition to window width.
- Poles will be cut to the exact length required and will be charged only to the next complete 10cm.
- Reeded, fluted and insert track poles are only available in 51mm, 63mm and 75mm diameters.
- We will endeavour to supply poles in one length up to 3m. Over 3m the poles will be in 2 pieces with a screw joiner.
- As a general rule of thumb, please allow 10 rings per 1m pole for standard curtain headings.
- When ordering insert track poles, please specify the type of track (brass/chrome or Silent Gliss) and colour of the track required (white, brown, gold, silver and black are available in Silent Gliss tracking). Please specify the length and number of the pull cords required and how the curtains are to operate i.e. to pull to the middle with one cord pull; a single curtain pulled to the left or right or to have two curtains that are operated independently with a cord at each side.
- Medium and small tassel pulls are not supplied with cord.
When ordering Brackets
- Please check that the brackets chosen are the correct size for the pole being used.
- Please ensure that the standard size of brackets will clear your architrave depth and that there is sufficient room below cornices, mouldings etc to position the brackets.
- Special extension and modified brackets can be made to order. Please provide detailed dimensions of your requirements. There will be a surcharge for this service.
- We recommend that poles over 2m long should have a centre bracket.
- If plain metal brackets are required for double poles, please state diameter and respective positions (back or front) of the poles being used and the overall extensions required.
- All brackets are supplied with appropriate wall fixings.
When ordering Holdbacks
- All holdbacks can be customised into swag holders using a wooden stem. Two sizes of swag rings are available; large (internal diameter 90mm) and small (internal diameter 52mm). A standard surcharge for large and small swag holders will be added to the holdback cost.
- Please note that holdbacks are supplied with a variety of styles of stems: wood, resin, brass, bronze and chrome. The standard style of each stem for each design of holdback is specified in the brochure. These can, however, be interchanged. Please specify the preferred length and style of stem if different from the standard. Brass stems are available in two sizes: 85mm and 110mm; and resin stems only in the single lengths specified. Wood stems can be turned to any length.
Standard Finishes & Colour Matching
- Standard colours can be applied to any of the items illustrated in the brochure, (excluding brass, nickel, chrome, bronze plated, moon plated and perspex items). Please specify the finish required for each item ordered.
- All goods are hand finished so very slight variations in colour may occur. Every effort is made to match wood colours but certain properties of wood, such as end grain, might result in colour variations. Resin products can be stained to dark wood colours only; light wood colours will be paint affected. If combinations of standard colours or colour matched colours are required, please give clear instructions with a diagram if relevant.
- Painted poles are protected with a clear satin or gloss lacquer and finished with wax to ensure rings run smoothly. We advise against a very matt finish on poles, as the friction from the rings will eventually burnish the surface to a shine and the rings will not run smoothly.
- When requesting colour matching, please supply as much information as possible e.g. fabric, wood and wallpaper samples.
- A surcharge will be added to the net cost of each item colour matched.
- Gold and Silver gilded (Dutch Metal) finish can be applied to any item. A surcharge will be added to the net cost of each item gilded (Dutch Metalled). If gilded detailing is required i.e. banding on finials, please give sufficient instructions or provide a diagram.
- Colour matching samples can be provided on individual wooden pegs. Please allow sufficient time before you place the order for samples to be approved.
- If colour matched samples are required on finials or holdbacks, an invoice will be raised for the full value of these items. However, if an order is placed requiring the same colour match, the cost of the sample (finial or holdback) will be deducted from the resulting invoice.
- We are unable to give credit notes or refunds on colour matched items if wrongly ordered. Colour matched items can be returned for repainting at an additional cost.
- A surcharge will be applied for painting the ‘flutes’ in a fluted pole in another colour i.e. a mahogany pole with deep gold flutes and reeds on a reeded pole.
General
- Some items in our brochure/website are hand painted. The Company, therefore, cannot accept any responsibility for slight variations in colour.
- All published dimensions are approximate.
- All designs are the property of the Company and under no circumstances are they to be reproduced or copied.
Delivery Lead Times
- We endeavour to dispatch orders within 28 days.
- If the order is required urgently we may, on prior agreement, arrange to dispatch the goods earlier than our standard lead times.
- Please do not book a pole fitter before the delivery date of goods has been arranged. We advise that the fitting is arranged for at least the day following delivery. (Delivery in the UK Mainland can be any time up to 5.30pm).
Carriage
- Our standard carriage service (UK Mainland) is based on a next working day delivery from date of despatch. Carriage arrangements to other destinations will be advised prior to acceptance of order.
- On this service we cannot specify at what time of day the goods will be delivered. If the addressee is not available to receive the goods, the carriers will try at least once to deliver again before returning the goods to us. If we have to dispatch the goods a second time, an additional invoice will be raised.
- Timed deliveries can be organised with prior arrangement and will be charged as per our carrier’s price list valid at that time.
Prices
- The Recommended Retail Prices printed in our retail leaflets and other publicity material include VAT and carriage charges within the UK.
- Prices printed in our trade literature are exclusive of VAT and carriage. VAT is charged at the rate applicable on the date of invoice.
- The Company reserves the right to review and change prices, product ranges and finishes at any time and therefore these are subject to alteration without notice.
- Discounts, where appropriate are applied to the invoices as a deduction from the net price.
Cancellation of Order
- In the event that you cancel your order prior to the commencement of production, you will be liable for a cancellation fee of 5% of the order value plus VAT.
- If production has commenced including the Company placing orders for materials required for the production of the order, you will be liable for a cancellation fee of 40% of the order value plus VAT.
- Subject to the Returns Policy set out below or the prior agreement of the Company, an order may not be cancelled after production is complete and the goods are ready for shipment.
Returns
- In the event of any query or concern about goods which we have supplied, please contact us with the reason for requesting the return of the goods, ensuring that you provide a telephone number on which to contact you if necessary.
- If a return is agreed, the Company reserves the right to levy a restocking fee equivalent to 20% of the net goods value with a minimum charge of £15.
- Disputed goods must be returned to McCormick-Weeks Limited within 7 working days from the date of delivery. A returns shipping label will be included with each delivery.
- As a Company supplying bespoke goods, it does not accept any goods for return unless consent has been expressly given.
- Unless otherwise agreed, any trade sale refunds will normally be issued as credit notes.
- The Company will not accept damage claims that have resulted from the misuse of the product.
Terms of Payment
- All customers will be dealt with on a proforma basis until a trading relationship has been established.
- All account invoices must be paid no later than the specified due date, usually 30 days from the date of invoice.
- Ownership of the goods remains with the Company until full payment is received for all goods comprised in this contract. If any of the goods have been resold before full payment, the Company’s right to ownership shall pass to the proceeds of such sale or to the claim for such proceeds.
- In the event of dishonoured cheques, the Company reserves the right to pass on any bank charges incurred.
- If the customer is in default as regards payment under the terms of this contract, the company may at its discretion:
- Terminate the account facility and resume proforma payment basis.
- Suspend deliveries until full payment is made.
- Instigate such legal proceedings as are deemed necessary to recover any outstanding amounts.
